General Terms and Conditions of MOOFJE Bicycle Sales

Effective Date: 01/01/2025

Article 1 - Applicability
These general terms and conditions apply to all agreements related to the sale of second-hand bicycles by MOOFJE. By making a purchase at MOOFJE, the customer agrees to these terms and conditions.

Article 2 - The Offer

  1. MOOFJE offers second-hand VanMoof bicycles. Each bicycle is sold as described in the product information.

  2. The sales prices include VAT.

  3. Bicycle images are as accurate as possible, but there may be minor differences in color or finish.

  4. MOOFJE does not offer delivery services; bicycles must be picked up by the customer.
     

Article 3 - Warranty

  1. MOOFJE provides a warranty on specific parts of the purchased bicycle, unless stated otherwise. The warranty varies depending on the bicycle's condition and specifications. The exact warranty terms are specified on the invoice received upon purchase. In case of discrepancies between the general terms and the invoice, the warranty terms on the invoice prevail.

  2. The following parts are excluded from the warranty unless stated otherwise on the invoice:

    • Battery

    • E-Shifter

    • Handlebar buttons

    • Cable loom

    • Cartridge

    • Wheels

    • Chain

    • Chain guard

    • Brakes

    • Frame

    • Mudguards

    • Tires

    • Lights

    • Saddle

  3. Damage caused by improper use, accidents, or lack of regular maintenance is not covered under the warranty.

  4. For warranty claims, the bicycle must be returned to MOOFJE for inspection. MOOFJE determines if the defect is covered by the warranty.
     

Article 4 - Payment

  1. Payment can be made in cash or via bank transfer. The bicycle will only be delivered after full payment is received.

  2. In case of late payment, MOOFJE may charge interest and collection fees.
     

Article 5 - Delivery

  1. MOOFJE does not provide delivery services; the customer is responsible for picking up the bicycle unless otherwise agreed.

  2. The bicycle must be picked up within 7 days of purchase unless otherwise agreed.
     

Article 6 - Liability

  1. MOOFJE is not liable for damage caused by improper use of the bicycle, negligent maintenance, or accidents involving a bicycle sold by MOOFJE.

  2. MOOFJE is not responsible for defects occurring after the warranty period.

  3. MOOFJE cannot be held liable for indirect damages, including consequential damages, lost profits, or damages resulting from the loss of data or materials.

  4. The customer is responsible for adhering to traffic rules and performing regular maintenance on the bicycle.

  5. The customer is responsible for assessing the condition of the bicycle at the time of purchase and regularly inspecting it after purchase.


Article 7 - Right of Withdrawal

  1. MOOFJE does not offer a right of withdrawal; all sales are final.
     

Article 8 - Force Majeure

  1. MOOFJE is not liable for delays or failure to meet obligations due to force majeure, including but not limited to natural disasters, strikes, pandemics, transport disruptions, or other events beyond MOOFJE's control.
     

Article 9 - Indemnification

  1. The customer indemnifies MOOFJE against any liability, claims, or demands from third parties regarding the use of the bicycle sold by MOOFJE.
